Once the modem is initialized HylaFAX won't know that the modem is unavailable in this scenario until it attempts a command and the command fails. Furthermore, once the modem is turned on again it will not likely be initialized properly for fax. Consequently, the next call will probably fail.

it then does report that its waiting to come ready
but shouldn't it detect this without a restart?

In HylaFAX+ (http://hylafax.sourceforge.net) there is a relatively new feature called "PollLockPokeModem" (that defaults to false) that can be enabled in the modem config file. Enabling this will achieve the result that you are asking for.

and still get the same behaviour
