Once the modem is initialized HylaFAX won't know that the modem is
unavailable in this scenario until it attempts a command and the
command fails. Furthermore, once the modem is turned on again it
will not likely be initialized properly for fax. Consequently, the
next call will probably fail.
if after turning the modem off
if I /etc/init.d/hylafax restart
it then does report that its waiting to come ready
but shouldn't it detect this without a restart?
In HylaFAX+ (http://hylafax.sourceforge.net) there is a relatively
new feature called "PollLockPokeModem" (that defaults to false) that
can be enabled in the modem config file. Enabling this will achieve
the result that you are asking for.

I tried PollLockPokeModem true
and still get the same behaviour
What version of HylaFAX+ are you using?
In your modem config file is it written "PollLockPokeModem true" without
the requisite colon after PollLockPokeModem?
Did you restart faxgetty?
