Absolutely it would be a modem feature. But older modems already do that in a sense for data calls.
They will cut off the phone jack (2 jacks in modem - 1 phone and 1 line) when it recognizes it's in data mode.
I have no idea if there's a AT command for that though.
But the TAD would need to be connected to the modem.


Also I'm sure they can listen in without being the one to take the line off hook. As long as the line is off hook basically they are still getting the same shifts as whatever other device took the phone off hook.

I don't know how fax machines do it. I mean, how do they "listen" to a line without taking it off-hook? I don't know.

In any case, what you describe would be a modem feature, and I'm not sure if any modems do support it. It would be an AT command of some kind to tell the modem to "listen indefinitely without taking the line off-hook".
