This OK after ATDT is/was a bug in the Agere Venus Class 1.0 implementation that I expect will be or has been fixed in MainPine's next generation hardware.

If you can identify the receivers for which this situation occurs then you could potentially use JobControl to disable V.34-Fax support in the call setup.

That said, most often this is not a consistent issue with every call attempt... so usually it will go through fine on the next call.
