FaxGetty error: MODEM /dev/ttyd1 appears to be wedged

If I could get some help on this it would be great!
I have been going over and over the mailing lists with no result.
I am using v4.0p12 on FreeBSD 3.4
I keep getting this error - there seems to be no communication
with my modem at all through Hylafax, yet cu, kermit work fine.
Probemodem works fine. My modem is a USR internal 56K fax modem (2.0)
/var/log/messages say only
Apr 24 07:18:21 tracker FaxGetty[187]: MODEM /dev/ttyd1 appears to be
wedged
which it repeats non-stop.
from FaxGetty - starting hfaxd seems to cause;

Address already in use
