Thanks for your help! for me the easiest fix was go back to ubuntu 9.04, everything is working right now!

I eventually switched over to have faxgetty started via upstart
entries in /ect/init/ so that it would restart after crashes.

example of my /etc/init/ttyR0.conf: (adjust for your tty, one tty per file)

start on stopped rc RUNLEVEL=[2345]
stop on runlevel [!2345]
respawn
exec /usr/sbin/faxgetty ttyR0
