flexfax: obsolete /dev/cua1 update to /dev/ttyS1

hi,

i've installed hylafax 4.1beta1-1rh6 from a rpm package for red hat linux, 
kernel ver. 2.2.5
it is working with an external modem "at&t dataport 2001", firmware rev n. 231.
my modem is attachet at com2 (/dev/cua1).

i can send faxes with sendfax, with the command:
sendfax -n -d phonenumber filename

  but it gave this message:

tty_io.c: process 1033 (faxsend) used obsolete /dev/cua1 - update software 
to use /dev/ttyS1


and sometimes, when i try to send a fax with sendfax, it puts the job into 
the file:
/var/spool/fax/sendq and doesn't send it.
in the logs, shows the message:

"waiting for modem to come ready"

and it only send the faxes if i run faxsetup again.

what is the problem? and how i can upgrade de devices from cua to ttyS?
